Welcome to 101pilates.
If you continue to use our service, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern 101pilates relationship with you in relation to this service. If you disagree with any part of these terms and conditions, please do not use our service.
Membership Agreement: a. By joining the gym, you acknowledge that you are at least 18 years old or have obtained consent from a legal guardian if you are under 18. b. Membership is personal and non-transferable. You may not assign or transfer your membership to anyone else.
Studio Access and Hours: a. Members are granted access to the studio during the operating hours specified by the management. b. The studio reserves the right to modify the operating hours or close the facilities for maintenance, repairs, or holidays. Notice will be provided to members whenever possible.
Code of Conduct: a. Members must conduct themselves in a respectful and responsible manner while using the studio facilities. b. Harassment, discrimination, or any form of inappropriate behavior towards other members or staff will not be tolerated and may result in immediate termination of membership. c. Members are expected to follow the rules and instructions provided by the gym staff regarding equipment usage, safety guidelines, and cleanliness.
Health and Safety: a. Members are responsible for ensuring that they are in good health and capable of engaging in physical exercise. It is advised to consult with a healthcare professional before starting any new exercise routines. b. Members are required to use studio equipment and facilities safely, following proper techniques and guidelines. Any damage caused by negligence or misuse may result in liability for repair or replacement costs.
Membership Fees and Payments: a. Membership fees are determined by the studio and are subject to change. Notice of any fee changes will be provided in advance. b. Membership fees are payable on a regular basis as per the agreed-upon schedule, such as weekly or monthly. c. Failure to pay membership fees within the specified timeframe may result in suspension or termination of membership.
Cancellation and Refunds: a. Members can cancel their membership by providing written notice to the studio. Any applicable cancellation fees or refund policies will be outlined in the membership agreement. b. Refunds may be provided on a case-by-case basis at the discretion of the studio management. c. 1-week cancellation period applies to terminating your membership (Fortnightly payment option has 2-weeks cancellation period). Within this time, you may receive a final bill. You are welcome to continue to use the studio until your 1-week (or 2-weeks) cancellation period expires.
Personal Belongings: a. The studio is not responsible for the loss, theft, or damage of personal belongings brought onto the premises. b. Members are encouraged to use lockers or other secure storage options provided by the studio to safeguard their belongings.
Amendments and Modifications: a. The 101pilates reserves the right to modify or amend these Terms and Conditions at any time. Notice of any changes will be communicated to members in advance.
Governing Law and Jurisdiction: a. These Terms and Conditions shall be governed by and construed in accordance with the laws of Victoria Government. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria Government.
By becoming a member, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions. Failure to comply with these terms may result in the termination of your membership.
The use of our 1:1 or duet training service is subject to the following terms of use:
•A single casual session or any casual session packages should be paid for all on that day.
•20 package casual sessions will expire within 6 months’ period time and 10 package within 3 months.
•If there are casual sessions left over and want to transfer to others. It can not be transferred to others (safety and insurance purpose). everyone has to have their own account
•Sessions can be held for specific reasons [including injury, holiday, etc.].
•Cancellation due to personal reasons should be announced 1 day prior to each session, and if cancelation happens twice for personal reasons the session may expire.
•All programs should be ended as per the contract.
Refund & cancellation Policy.101 studio is committed to 100% customer satisfaction. You can claim your unused sessions to refund anytime under Refund policy.
•A cancellation fee of 10% refund will be applied.
•Pilates membership will take 1 weeks terminate period.
•You will be able to get a 100% full refund for specific reasons (including injury, natural disaster, etc.).
101pilates is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Australian Information Commissioner at www.aoic.gov.au

Weekly & Fortnightly Membership Only
By purchasing, enrolling in, or using a 101 Pilates Group Membership, members acknowledge that they have read, understood, and agreed to the following Terms and Conditions.
These Terms and Conditions apply to Weekly and Fortnightly Group Memberships only.
1. Membership Eligibility: 1.1 Group memberships are available to individuals aged 18 years or older only. 1.2 Participants under 18 years of age are not eligible to attend group classes unless otherwise approved in writing by 101 Pilates.1.3 Memberships are personal and non-transferable.1.4 Members must provide accurate and up-to-date personal information during registration.1.5 Members are responsible for ensuring their contact details and payment information remain current.
2. Membership Payments: 2.1 Membership fees are charged automatically according to the selected membership type, either Weekly or Fortnightly. 2.2 Members are responsible for maintaining valid payment details and ensuring sufficient funds are available for scheduled payments. 2.3 Accepted payment methods include direct debit and card payment methods. 2.4 Membership fees are generally non-refundable unless otherwise stated in writing by 101 Pilates or required by law. 2.5 Membership fees, payment terms, and studio policies may be updated from time to time with prior notice where appropriate. 2.6 Failed or overdue payments may result in restricted booking access, suspension of membership, or additional administrative action.
3. Class Bookings: 3.1 Members may book classes up to 1 week in advance. 3.2 Class bookings close 3 hours before the class start time, subject to availability. 3.3 Members may hold a maximum of 2 active bookings per day. 3.4 All bookings are subject to class availability. 3.5 Members are responsible for managing their own bookings through the approved booking system or other method provided by 101 Pilates. 3.6 Any booking made within 6 hours of the class start time is considered confirmed and may be subject to the Late Cancellation or No Show policy.
4. Class Cancellations by Members: 4.1 Members may cancel a class booking up to 6 hours before the class start time without penalty. 4.2 Cancellations made less than 6 hours before the class start time will be treated as a Late Cancellation. 4.3 Failure to attend a booked class without cancelling will be treated as a No Show. 4.4 Members are responsible for cancelling their own bookings within the required cancellation window.
5. Late Cancellation and No Show Policy: 5.1 A “Late Cancellation” means cancelling a booked class less than 6 hours before the class start time. 5.2 A “No Show” means failing to attend a booked class without cancelling in advance.
Late Cancellation
5.3 For a Late Cancellation, the following may apply:

$15 Late Cancellation Fee; and
-
1 class credit will be deducted.
No Show
5.4 For a No Show, the following may apply:
-
$25 No Show Fee; and
-
1 class credit will be deducted.
5.5 Fees may be charged to the member’s nominated payment method or card on file. 5.6 Exceptions may be considered at management discretion in genuine emergency situations. Supporting documentation may be requested where appropriate.
6. Membership Cancellation: 6.1 Weekly Memberships require a minimum of 1 week written notice for cancellation. 6.2 Fortnightly Memberships require a minimum of 2 weeks written notice for cancellation. 6.3 The notice period begins from the date written notice is received by 101 Pilates, unless otherwise confirmed by management. 6.4 Membership remains active during the notice period. 6.5 Final membership payments may still apply during the notice period. 6.6 Members may continue attending classes until the notice period ends, provided the membership remains in good standing. 6.7 Cancellation requests must be submitted in writing. Verbal cancellation requests may not be accepted. 6.8 Payments already processed for elapsed membership periods or membership access already used are generally non-refundable.
7. Membership Freeze: 7.1 Membership freeze requests must be submitted in writing and are subject to approval by 101 Pilates. 7.2 Freeze requests must include both a requested start date and end date.
7.3 A one-off freeze fee applies as follows:

Less than 4 weeks: $5

4 weeks or longer: $10
7.4 Freeze fees may be added to the next scheduled payment. 7.5 Future billing dates may be adjusted according to the approved freeze duration. 7.6 Freeze periods cannot be applied retrospectively unless approved by management. 7.7 101 Pilates reserves the right to decline a freeze request where the request does not meet studio policy requirements.
8. Class Operation and Minimum Numbers: 8.1 Group classes are subject to minimum participant requirements. 8.2 Reformer classes require a minimum of 2 participants. 8.3 Barrel & Chair classes require a minimum of 1 participant. 8.4 If a class does not meet the minimum participant requirement, 101 Pilates may cancel the class. 8.5 If a class is cancelled by 101 Pilates, the class credit will be returned to the member account where applicable. 8.6 Credit validity may be extended where applicable. 8.7 Instructor schedules, class types, and class timetables may change where necessary. 8.8 Changes to instructors, class format, or timetable do not automatically entitle members to a refund.
9. Refund Policy: 9.1 Membership fees are generally non-refundable. 9.2 Payments already processed for elapsed membership periods or membership access already used are generally not refundable. 9.3 Refund requests may be reviewed case-by-case at management discretion. 9.4 Refund requests must be submitted in writing. 9.5 If a class is cancelled by 101 Pilates, members may receive returned credits, account credits, rescheduled classes, or alternative arrangements where applicable. 9.6 Nothing in these Terms and Conditions excludes any rights members may have under applicable Australian Consumer Law.
10. Studio Conduct: 10.1 Members are expected to behave respectfully toward instructors, staff, and fellow members at all times. 10.2 Members must follow instructor guidance and studio safety rules. 10.3 Members must use all equipment safely and appropriately. 10.4 Disruptive, unsafe, disrespectful, abusive, or inappropriate behaviour may result in refusal of entry, suspension, or cancellation of membership. 10.5 101 Pilates reserves the right to remove any member from a class or studio where their behaviour creates a safety risk or negatively affects others.
11. Health, Safety and Liability: 11.1 Members understand that Pilates and physical exercise involve inherent risks, including the risk of injury. 11.2 Members are responsible for ensuring they are medically fit to participate in classes. 11.3 Members must inform instructors before class of any injuries, medical conditions, pregnancy, physical limitations, or other health concerns that may affect their ability to participate safely. 11.4 Members agree to follow instructor guidance and exercise within their own ability.
11.5 Members should stop exercising and notify the instructor immediately if they experience pain, dizziness, discomfort, or any unusual symptoms during class. 11.6 To the extent permitted by law, 101 Pilates, its owners, instructors, staff, and representatives will not be liable for any injury, accident, loss, or damage arising from participation in classes or use of the studio, except where caused by negligence or where liability cannot be excluded under applicable law.
12. Personal Belongings: 12.1 Members are responsible for their own personal belongings brought into the studio.
12.2 101 Pilates is not responsible for the loss, theft, or damage of personal belongings, including bags, phones, jewellery, clothing, or other valuables. 12.3 Members are encouraged not to bring unnecessary valuables into the studio.
13. Intellectual Property: 13.1 All class materials, training content, handouts, presentations, resources, social media content, and studio-created materials are protected by intellectual property rights. 13.2 Members may use such materials for personal use only.
13.3 Members must not copy, reproduce, distribute, publish, record, or share any class materials or studio-created content without prior written consent from 101 Pilates. 13.4 Members must not film, photograph, or record instructors, staff, other members, or classes without prior approval from 101 Pilates.
14. Photography and Videography: 14.1 From time to time, 101 Pilates may take photographs or video recordings within the studio for instructor training, educational, operational, social media, marketing, or promotional purposes.14.2 Where possible, recordings will focus on instructors rather than members, and reasonable efforts will be made to avoid capturing clearly identifiable images of members.14.3 Members who do not wish to appear in any photographs or video recordings may notify staff at any time.14.4 101 Pilates will make reasonable efforts to accommodate such requests, including avoiding filming the member where practicable or removing content where reasonably possible.14.5 By attending the studio, members acknowledge that incidental background appearance in studio photographs or video recordings may occur. 14.6 Members must not take photographs or video recordings of other members, instructors, or staff without their consent and prior approval from 101 Pilates.
15. Privacy: 15.1 Member information will be collected, used, and managed for membership administration, class bookings, payment processing, communication, safety, and studio operation purposes.15.2 Member information will be managed in accordance with applicable Australian privacy laws.15.3 101 Pilates will not share member information with third parties without consent, except where required for operational, payment, legal, safety, or administrative purposes.15.4 Members are responsible for keeping their contact and payment details up to date.
16. Governing Law: 16.1 These Terms and Conditions are governed by the laws of Victoria, Australia. 16.2 Any disputes arising from these Terms and Conditions shall be dealt with in accordance with the laws and courts of Victoria, Australia.
17. Changes to Terms and Conditions: 17.1 101 Pilates reserves the right to update these Terms and Conditions from time to time. 17.2 Any significant changes will be communicated where appropriate. 17.3 Continued use of 101 Pilates services after changes are made will be taken as acceptance of the updated Terms and Conditions.
